These Terms & Conditions explain the rules for using FindABrit, creating an account and listing a business on the directory.

By using FindABrit, creating an account, submitting a business application or creating a business listing, you agree to these Terms & Conditions where they apply to you.

Please read them alongside our Listing Criteria and Privacy Policy.

1. About FindABrit

FindABrit is an online directory designed to help people discover and support British businesses.

The directory may include independent businesses, tradespeople, retailers, manufacturers, makers, farms and food producers, accommodation providers, professional services, online businesses and other businesses accepted by FindABrit.

FindABrit provides the directory and related website services. Unless we expressly state otherwise, we are not the seller, supplier, employer, agent, representative or partner of businesses listed on the site.

Any contract for goods or services is between the customer and the relevant business.

2. Using FindABrit

You may browse and search the public areas of FindABrit without creating a business listing.

You must not misuse the website, interfere with its normal operation, attempt to gain unauthorised access to accounts or systems, introduce malicious software, scrape the site in a way that places an unreasonable burden on our systems, or use FindABrit for unlawful purposes.

We may restrict or block access where reasonably necessary to protect FindABrit, its users, businesses or systems.

3. Member accounts

Some FindABrit features may require a member account.

You are responsible for providing accurate account information and for keeping your login details reasonably secure.

You are responsible for activity carried out through your account unless the activity results from something for which FindABrit is legally responsible.

If you believe somebody has gained unauthorised access to your account, you should contact us as soon as reasonably possible.

4. Business applications

Creating a member account does not automatically give you permission to list a business.

Businesses wishing to appear in the directory may be required to submit an application for approval.

Applications are reviewed by FindABrit. We may approve, refuse or ask for further information about an application.

Approval of an application gives the account permission to use FindABrit’s business listing features, subject to these Terms and our Listing Criteria.

Approval does not guarantee that every listing submitted by the business will be published.

5. Listing approval

Business listings may be reviewed separately before publication.

We may request changes, corrections or additional information before publishing a listing.

We may refuse a listing that does not meet our Listing Criteria or that we reasonably believe is unsuitable for the directory.

FindABrit is a curated directory. Submission of an application or listing does not create an automatic right to publication.

6. Listing Criteria

Businesses listed on FindABrit must comply with our Listing Criteria.

The Listing Criteria form part of the rules governing business listings and may cover matters including suitability for the directory, accuracy, business legitimacy, misleading claims, British-made claims, prohibited activity and standards of conduct.

Businesses are expected to continue meeting the Listing Criteria for as long as they remain listed.

7. Information provided by businesses

Businesses are responsible for the accuracy of information they submit to FindABrit.

You must not knowingly provide false, materially inaccurate or misleading information about your business, location, products, services, qualifications, experience or other relevant matters.

Where you describe something as British made, British manufactured, locally produced or use another claim about origin, you are responsible for ensuring that claim is accurate and not misleading.

You should update important listing information when it changes.

8. Content you upload

You retain ownership of content that belongs to you, including your business photographs, logo and original written material.

By uploading or submitting content to FindABrit, you give us a non-exclusive licence to host, store, reproduce, resize, display and otherwise use that content as reasonably necessary to operate, promote and display FindABrit and your listing.

You confirm that you own the content you submit or otherwise have the necessary permission to use it.

You must not upload material that unlawfully infringes another person’s copyright, trade mark, privacy or other rights.

9. Editing listings

Businesses may be able to edit their own listing through their account.

FindABrit may also correct formatting, categorisation, obvious errors or other presentation issues where reasonably necessary to maintain the directory.

We will not knowingly make changes that materially misrepresent the business.

10. Reviews, complaints and investigations

A negative review or customer complaint does not automatically result in a business being removed from FindABrit.

However, serious complaints or a pattern of credible complaints may cause us to review a business or listing.

Where appropriate, we may ask the business or other relevant parties for information before deciding what action, if any, should be taken.

Depending on the circumstances, we may take no action, request corrections, temporarily take a listing offline, restrict business access or revoke approval.

FindABrit is not required to determine every private dispute between a customer and a business and does not act as a court, regulator or arbitration service.

11. Suspension and revocation

We may suspend a listing or revoke business access where we reasonably believe there has been a serious or repeated breach of these Terms, our Listing Criteria or another rule applying to the directory.

We may also take action where reasonably necessary because of fraud, materially misleading information, unlawful activity, abuse of the service, serious misconduct affecting FindABrit, or another substantial reason relating to the integrity or operation of the directory.

Where appropriate, we may tell the business why access has been restricted or revoked.

Revoking business access may cause published listings belonging to that business to be taken offline.

12. Business listing charges

FindABrit may charge businesses for maintaining a business listing or accessing particular business features.

The current price and features of any paid business membership or listing plan will be displayed on FindABrit before a business subscribes.

Where existing business listings are moving from free to paid access, affected businesses will be given notice before payment is required.

We will not automatically begin charging an existing business simply because paid listings are introduced.

A business must actively choose to subscribe and authorise the relevant payment before recurring charges begin.

13. Recurring subscriptions

Where a business chooses a recurring subscription, the price, billing frequency and other relevant payment information will be shown before the subscription is authorised.

Recurring payments will continue according to the selected subscription until the subscription is cancelled or otherwise ends.

Businesses are responsible for maintaining a valid payment method where required.

14. Complimentary listings

FindABrit may, at its discretion, grant a business complimentary listing access.

A complimentary listing gives the business access to the applicable standard listing without requiring the normal subscription payment while complimentary status remains active.

Complimentary status does not change the business’s obligation to comply with these Terms or our Listing Criteria.

Unless we expressly agree otherwise, complimentary status may be withdrawn by FindABrit. Removing complimentary status does not by itself mean that the business has breached our rules or done anything wrong.

If payment is required following the removal of complimentary status, no recurring payment will be taken unless the business actively authorises a subscription.

15. Failed payments and grace periods

If a recurring payment fails, we may allow a reasonable grace period during which the business can correct the payment problem.

Where a grace period applies, the listing may remain active temporarily.

If payment is not successfully resolved by the end of the applicable grace period, we may take the business listing offline.

Taking a listing offline for non-payment does not necessarily delete the business’s account or listing information.

16. Cancelling a paid business subscription

A business may cancel its recurring subscription using the cancellation method made available through FindABrit or the relevant payment service.

Cancellation stops future recurring renewals.

Unless otherwise stated or required by law, cancelling a subscription does not automatically entitle the business to a refund for a period that has already been paid for.

Where applicable, the listing may remain active until the end of the period already paid for and may then be taken offline.

17. Refunds

Any refund entitlement will depend on the circumstances, the service purchased and applicable law.

Nothing in these Terms excludes any refund or other remedy that you are legally entitled to receive.

Where no legal right to a refund exists, any discretionary refund is at FindABrit’s discretion.

18. What happens when a listing becomes inactive?

If a listing becomes inactive because a subscription ends, payment is not made or another non-disciplinary account change occurs, we may take the listing offline without immediately deleting the underlying listing information.

This allows an eligible business to return later without necessarily having to create its listing again.

A returning listing may require review before being republished.

19. Deleting an account

Users may request deletion of their FindABrit account, subject to any information we are legally required or otherwise entitled to retain.

Deleting an account may also result in associated listings being deleted or taken offline.

If a business has an active paid subscription, the recurring subscription should also be cancelled as part of closing the relevant paid business account.

We may retain limited records where reasonably necessary for legal, accounting, fraud prevention, dispute resolution or regulatory purposes.

20. Businesses removed by FindABrit while subscribed

If FindABrit suspends or removes a business that has an active paid subscription, we will take reasonable steps to prevent further recurring charges once the paid business relationship has been terminated.

Any entitlement to a refund for an amount already paid will depend on the circumstances, these Terms and applicable law.

We will not intentionally continue collecting recurring listing payments from a business after its paid listing access has been terminated by us.

21. Changes to prices and plans

We may change the price or features of business plans in the future.

Where a change affects an existing recurring subscription, we will provide any notice required by applicable law and the terms applying to that subscription.

We will not retrospectively charge businesses for periods during which no paid subscription was authorised.

22. FindABrit does not guarantee listed businesses

We review businesses and listings for suitability for the directory, but inclusion on FindABrit is not a guarantee, certification or warranty of a business.

We do not guarantee the quality, safety, legality, availability or suitability of goods or services supplied by businesses listed on FindABrit.

Customers should make their own checks before purchasing goods, making payments, booking services or entering into contracts.

23. Transactions between users and businesses

FindABrit is not normally a party to transactions arranged between directory users and listed businesses.

Questions about an order, booking, workmanship, delivery, refund or other transaction should ordinarily be raised with the relevant business.

Nothing in these Terms affects any statutory rights a customer may have against the business supplying the goods or services.

24. Availability of FindABrit

We aim to keep FindABrit available and functioning properly, but we cannot guarantee uninterrupted or error-free access.

The site may occasionally be unavailable because of maintenance, technical problems, security issues or circumstances outside our reasonable control.

We may change, update, replace or discontinue particular website features where reasonably necessary.

25. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Subject to those rights and any other liability that cannot legally be excluded, FindABrit is not responsible for losses caused by the acts, omissions, products or services of independent businesses listed in the directory.

For business users, FindABrit will not be liable for indirect or consequential loss, loss of profit, loss of business, loss of opportunity or loss arising solely from an expectation of enquiries, customers, sales, website traffic or search-engine visibility from a listing, except where such liability cannot lawfully be excluded.

26. No guarantee of enquiries or results

Paying for or receiving a business listing does not guarantee enquiries, customers, sales, bookings, revenue, search-engine rankings or any particular level of exposure.

The purpose of a listing is to provide visibility within the FindABrit directory and the features described for the relevant plan.

27. Intellectual property belonging to FindABrit

The FindABrit name, branding, website design, original written content, software and other material belonging to FindABrit may be protected by copyright, trade mark and other intellectual property rights.

You may use the website normally for its intended purpose but may not copy or commercially exploit FindABrit’s protected material without permission unless the law allows you to do so.

28. Changes to these Terms

We may update these Terms from time to time as FindABrit develops, including when new features or business services are introduced or where changes are required for legal, regulatory or security reasons.

The current version will be published on this page.

Where a material change significantly affects an existing paid service, we will provide reasonable notice where appropriate or legally required.

29. Governing law

These Terms are governed by the laws of England and Wales, subject to any mandatory rights you may have under the law that applies to you.

Any dispute will be dealt with by the courts having jurisdiction under applicable law.

We’re trying to build a useful directory that helps people find and support genuine British businesses.

Be honest about your business, keep your listing accurate, treat people reasonably and follow the rules of the directory.

We’ll do our best to run FindABrit fairly, keep businesses informed about important changes and never start taking recurring payments from an existing business without that business choosing to subscribe.

That’s the spirit in which these Terms are intended to operate.
